Care proceedings guide

Legal Aid for Care Proceedings

Legal aid rules for public-law children cases differ from most private family disputes. Parents and certain people with parental responsibility usually receive non-means-tested, non-merits-tested legal aid when a local authority issues specified care or supervision proceedings.

Court proceedings

When the local authority issues qualifying proceedings, a parent or person with parental responsibility will generally not need to pass the usual financial eligibility or merits tests for representation. The solicitor must still verify identity, status and the nature of the proceedings.

Funding can cover legal advice, preparation, representation and work with counsel or approved experts where required by the case and funding rules.

  • Care Order applications
  • Supervision Order applications
  • Interim hearings and case management
  • Final hearings and connected representation

PLO and pre-proceedings advice

A parent who receives a formal Letter Before Proceedings may qualify for legal help for advice and representation during the Public Law Outline process. The letter is important evidence of the funding route, so provide the complete document when contacting a solicitor.

Earlier social-work involvement, child-protection meetings or assessments do not always carry the same automatic funding position. Eligibility must be checked against the precise stage and documents.

What to provide

Send the court application, hearing notice or Letter Before Proceedings as soon as possible. Also provide identification, details of parental responsibility and any immediate deadline.

Do not delay urgent advice because you are unsure about funding. A care proceedings solicitor can identify the applicable legal aid route after reviewing the documents.

Common questions

Is legal aid means tested for parents in care proceedings?

For parents and certain people with parental responsibility in specified local-authority proceedings, legal aid is generally available without the usual means or merits tests.

Can I receive legal aid for a PLO meeting?

Formal pre-proceedings letters can provide access to legal help for eligible parents. Your solicitor must review the letter and confirm the funding position.
