When the Court Refused Contact to Protect Five Children
This anonymised case study is based on a matter handled by our solicitor in previous practice. Details have been limited to protect confidentiality.
The court dismissed a contact application after serious safeguarding concerns and sustained failure to engage with proceedings.
The situation
A father applied for contact with five children despite serious concerns raised by the mother. These included alleged abuse, substance misuse, threats and behaviour affecting the children's emotional wellbeing. A Non-Molestation Order was already in place.
The older children expressed clear views against contact, and one child's anxiety had been significantly affected. The court initially limited the father to indirect communication while evidence was gathered.
Evidence and engagement
The mother complied with directions and provided a detailed schedule of allegations and supporting evidence. The father failed to file required evidence, respond consistently, sustain indirect contact or attend the final hearing.
That pattern of non-engagement became central when the court assessed whether continued proceedings or contact would serve the children's welfare.
- Safeguarding evidence was presented in a structured form
- The children's wishes and emotional welfare were considered
- Compliance with court directions affected credibility
- Interim restrictions protected the children while evidence was reviewed
The outcome
The contact application was dismissed and the interim indirect-contact arrangement ended with the proceedings. The outcome gave the family certainty while leaving scope for safe, low-level communication in the future if appropriate.
